Timescales
Timescales for your case may vary depending on factors such as lawyers’ availability, the complexity of your case and work needed, the need for additional documents, the other side’s approach and the Courts availability for listing your matter.
The timings will also be affected by any agreements/negotiations you have made with the other side, and any external factors such as witnesses’ availability or third-party involvement. As a guide the more straightforward cases tend to have hearing dates listed in Court within 8-12 months of a claim being issued.

Fees

Clients’ may contact the firm to obtain a quotation for legal services. Due to the individual circumstances which surround cases in which we are asked to advise and represent clients upon, it is not always practical to give exact total costs for all services that Charles Morgan Lawyers provide.

Once we properly understand your circumstances and requirements, we will always give you an individual cost estimate at the start of your instruction with no obligation to instruct, and then for each stage thereafter.

Grade A = Solicitors and Barristers with over eight years post qualification experience including at least eight years litigation experience.

Grade B = Solicitors and Barristers with over four years post qualification experience including at least four years litigation experience.

Grade C = Other Solicitors and Barristers and fee earners of equivalent experience.

Grade D = Trainee solicitors, paralegals and other fee earners.

Immigration Appeals

Immigration appeals can be relatively straightforward or incredibly complex. The work that is undertaken is broad and is entirely dependent upon the individual circumstances of the matter. For that reason, it is not practicable for us to provide a total cost of the service covering all eventualities.

If you wish to appeal against a Home Office visa or immigration decision, our lawyers can advise and represent you. You can ask us just to submit an appeal form or ask for a hearing at the First-tier Tribunal (Immigration and Asylum Chamber) – our lawyers can advise you about this. The First-tier tribunal can also itself decide to hold a hearing.

Please note that our lawyers are not allowed to do legal aid work on a Public Access basis. Timescales for your case may vary depending on factors such as lawyer’s availability, the complexity of your case and the need for additional documents. You must appeal a decision within 14 days (from within the UK) or 28 days (from outside the UK), please contact the firm as soon as possible. You may also need advice and/or representation at short notice. If so, please contact the firm: our lawyers will aim to advise you and/or represent you at a hearing where possible.

Our charges can be based either upon a minimum fee, for certain components, an hourly rate, or a combination of the two depending upon your individual circumstances including your and the other parties’ approach to the matter. It is not possible to provide a fixed price for each component part of a case without knowing the intricacies of each stage of the proceedings. As a guide our lawyers charge an hourly rate ranging between £250 per hour and £350 per hour (plus VAT where applicable) and minimum fees can be agreed based on the preparation and court time for each specific circumstance.

We may charge fixed fees, which means that we will charge you a set amount of money for the work. Below we provide estimates based on the ranges of indicative fees for Charles Morgan Lawyers.

If we charge fixed fees, these may vary depending on your needs – for example, your fees may be towards the higher end of the range if you need a more experienced lawyer. If you have a particularly complex case, your fees may also be higher than the estimates below. There are also likely to be additional costs for disbursements such as court fees and instruction of external barristers.

Complaints Procedure

We aim to offer all clients an efficient and effective service. If you are dissatisfied with any aspect of our service, or about your bill, you should raise it first with the person supervising your matter.

If you feel that this is inappropriate, or you are not happy with the response then please put your complaint in writing, in compliance with our complaint’s procedure (a copy is available on request), addressed to Zarina Sulaiman-Zeb by post to our main office. We will promptly and thoroughly investigate any complaint you may have. If you are not satisfied with our handling of your complaint, you can ask the Legal Ombudsman Service to consider the complaint. The Legal Ombudsman can be written to at PO Box 6806 Wolverhampton WV1 9WJ.

Normally you need to bring a complaint to the Legal Ombudsman within six months of receiving a final written response from us about your complaint or within six years if the act or omission about which you are complaining (or if outside of this period, within three years of when you should reasonably have been aware of it). In relation to your bill, you may also have the right to apply to the Court for an assessment of it under Part III of the Solicitors Act, 1974, but if you do the Legal Ombudsman may not consider a complaint about a bill.
